Except the only way to get their billions is also to destroy the settlement.
That seems like putting the cart before the horse. Or at least, logically of course the settlement which protects their billions would need to be destroyed.
The US govt doesn't need their billions for the settlement, it's pocket change for the feds. Justice is worth far, far more than a few billion.
