The key word here is “secretly”.

And a Chinese company could secretly do it.

Any legal deterrent can be waved away by saying “but what if they do it secretly?”

It doesn't change the fact that US companies are subject to US laws. Conspiracy would just make the penalties steeper. Is it pointless to have laws against fraud, espionage, tax evasion, etc?
